Public website content is informational. Paid services, service levels, support commitments, and customer responsibilities are controlled by the executed order and these terms. Vanguard Racks is a Kansas, United States business, and these terms are to be read against Kansas law and applicable federal requirements.
Terms of Service
The agreement between you and Vanguard Racks: what we sell, what we owe you, and what ends the relationship.
All services bill month to month unless you select a quarterly or annual cycle. There are no setup fees and no minimum term. Invoices are issued in advance of the service period and are due on issue. Quarterly and annual cycles are discounted 5% and 10% respectively and are paid up front.
A failed payment is retried on days 0, 3, and 5. Service is suspended on day 7 and terminated on day 14. Before termination we offer a final copy of your data. Suspension does not cancel accrued charges.
You may cancel any service at any time from the client portal, effective at the end of the current billing period. We do not pro-rate refunds on cancellation except under the money-back guarantee in the Refund Policy.
We may suspend or terminate service for breach of the Acceptable Use Policy, for non-payment, or where continuing to serve a customer would put other customers or our infrastructure at risk. Where the situation allows it, we give notice first.
Our aggregate liability for any claim is limited to the amount you paid for the affected service in the three months preceding the claim. We are not liable for lost profits or consequential loss. Nothing here limits liability that cannot lawfully be limited.
Cross-border service delivery may involve additional tax, privacy, sanctions, export control, and data transfer requirements. International customers should expect final contracts and data handling terms to reflect their jurisdiction and the actual service architecture in use.
